Terms of Service

Agreement

By creating an account or using Markie-X, you agree to these terms and our Privacy Policy. The service is provided by the operator of Markie-X ("we", "us"). If you use it on behalf of a company, you confirm that you are authorised to bind that company, and "you" means the company. You must be at least 18.

Accounts and workspaces

Each account comes with a workspace, which can hold one or more brands. Give us accurate information and keep your password confidential. You are responsible for everything done through your account. Tell us promptly at hello@markiex.com if you suspect unauthorised access.

The service

Markie-X lets you build a brand profile (including Brand DNA from your website and files), plan campaigns, generate ideas, plans, copy, key visuals and storyboards, and export material such as PowerPoint decks. We continually improve the service and may add, change or remove features. We aim to keep it available but do not promise uninterrupted service; generations can occasionally fail or be delayed.

Plans, credits and billing

• Plans. Paid plans are subscriptions billed monthly in advance through Stripe at the price shown on our pricing page. A free trial may include a one-time allowance of credits.
• Credits. AI features consume credits at rates that depend on the task and model. The current rates are shown in the app. A generation will not start if your balance is too low or your subscription is inactive.
• Monthly reset. Each billing period your balance is reset to your plan's monthly allowance. Unused credits do not roll over and have no cash value.
• Upgrades. You can move to a larger plan at any time. The price difference for the rest of the current billing period is charged straight away, and your balance goes up to the new plan's allowance. Plans cannot be moved to a smaller plan; to reduce your plan, cancel and subscribe again after the current period ends.
• Cancellation. You can cancel at any time in the billing portal. Cancellation stops future renewals. Except where required by law, payments are non-refundable, including for partly used periods and unused credits.
• Failed payments and price changes. If a payment fails, your subscription may be marked past due and access to generation limited until it is resolved. We will give notice of price changes before they apply to your next billing period.
• Taxes. Prices exclude applicable taxes unless stated otherwise.

Your content

You keep ownership of the content you provide, such as brand information, files, briefs and answers ("Your Content"). You give us a limited licence to host, copy, process and transmit Your Content, including sending it to our AI and research providers, only as needed to provide and support the service for you. We do not use Your Content to train AI models or share it with other customers.

You confirm that you have the rights needed to provide Your Content, including logos, images and any personal information about stakeholders or customers, and that our use of it as described here will not infringe anyone's rights or break any law.

AI output

As between you and us, you own the material generated for you ("Output") and may use it for your business, subject to these terms and to the rights of others. AI output is produced automatically and may be inaccurate, incomplete, similar to output generated for others, or may unintentionally resemble third-party material. Market research and competitor summaries are drawn from public web sources that we do not verify.

You are responsible for reviewing Output before you use it, including checking facts and claims, and making sure it complies with advertising standards, platform rules, and trademark, copyright, privacy and consumer-protection laws.

Acceptable use

You must not use Markie-X to:

• create content that is unlawful, deceptive, defamatory, harassing, hateful, sexually explicit, or that promotes violence or self-harm;
• impersonate another person or brand, or build a brand profile or campaign for a business you do not represent without permission;
• infringe intellectual property, privacy or publicity rights, or upload personal data you are not entitled to share;
• produce spam, misleading health, financial or political claims, or content that breaks the rules of the platforms you publish on;
• break any usage policy of our AI model providers;
• probe, scrape, overload or bypass the security, rate limits or credit controls of the service, or reverse-engineer it;
• resell or provide the service to third parties as a standalone product without our written agreement.

Our intellectual property

The service, including its software, design, templates, prompts and the Markie-X name and logo, belongs to us or our licensors. Apart from the right to use the service under these terms, you receive no rights in it. If you send us feedback, we may use it without any obligation to you.

Third-party services

The service relies on third parties, including Stripe for payments and AI model providers for generation. Their services are subject to their own terms, and we are not responsible for them. Exports to other tools, such as outlines for Gamma or PowerPoint files, are your responsibility once they leave Markie-X.

Suspension and termination

You can stop using the service and delete your account at any time from Settings. We may suspend or end your access if you breach these terms, fail to pay, or create a risk for us, other users or third parties. Where reasonable we will give notice first. When an account is deleted, its workspace content is deleted as described in our Privacy Policy. Please export anything you need beforehand. Sections that by their nature should survive termination will survive.

Disclaimers

To the extent the law allows, the service and all Output are provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes fitness for a particular purpose, accuracy, non-infringement, and any particular marketing or business result.

Limitation of liability

To the extent the law allows, we will not be liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You will defend and indemnify us against third-party claims arising from Your Content, your use of Output, or your breach of these terms.

Governing law

These terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute, unless mandatory local law gives you the right to bring a claim elsewhere.

Changes and contact

We may update these terms. We will post the new version here with a new effective date and give notice in the app or by email of material changes. If you keep using the service after the changes take effect, you accept them. Questions: hello@markiex.com.
